What Should Employers Change in Their Relocation Policies for 2027?

Your relocation policy has a shelf life, and for a lot of employers, it’s about to run out. A relocation policy 2027 update should start with repayment clauses. Connecticut’s new repayment ban took effect on October 1. New York’s follows in early 2027. California’s was pushed back to January 1, 2027, but it’s still coming.

Those three dates alone can make a standard repayment clause unenforceable in states where you have employees. And repayment is only one of five things worth fixing.

Below is a relocation policy checklist, built from the latest laws and survey data, with a clear reason behind each change.

1. Rewrite Your Repayment Clause Before State Law Does It for You

Most relocation policies make employees repay the money if they quit within one or two years. That used to be routine. Now it’s a patchwork.

State Status What it means for relocation repayment
Connecticut Expanded law effective Oct. 1, 2026, now covering all employers Repayment duties tied to leaving early are void. Relocation isn’t on the exceptions list (CBIA).
New York “Trapped at Work Act” operative Feb. 13, 2027 (some read it as Dec. 19, 2026) Relocation repayment is allowed only in narrow cases, such as misconduct or misrepresented duties (Holland & Knight).
California AB 692 now applies to agreements signed on or after Jan. 1, 2027 Relocation is among the restricted arrangements. A “discretionary payment” exception may reach some bonuses, but only if every condition is met (Greenberg Traurig).

Here’s what to change –

  • Map your headcount by state. Don’t write one clause for everyone.
  • Add state riders. Keep the national agreement, then attach state-specific terms for Connecticut, New York and California.
  • Shorten and prorate. Under California’s discretionary exception, for example, the retention period can’t exceed two years, repayment must be prorated, and no interest is allowed.
  • Offer a better deal instead. If you can’t claw back, you can pay in stages, such as half at the move and half at six months.

For second moves, see our repeat relocation policy rules, since overlapping agreements are where these laws bite hardest. Have employment counsel review everything. The rules differ by state and keep changing.

2. Budget as if the Moving Tax Break Is Never Coming Back

It isn’t. The One Big Beautiful Bill Act made the suspension of the moving expense deduction and the employer reimbursement exclusion permanent, with exceptions for the military and the intelligence community (Foster Garvey). So every dollar you reimburse is taxable wages, and you have to withhold on it.

The most common lump sum is still $10,000 to $12,499, the same band for three years running (Atlas Van Lines, via Plus Relocation). In Relo.AI’s year-end tax analysis, a $12,000 lump sum leaves an employee about $8,440 before state tax. Delivering a true $12,000 takes a gross-up of roughly $17,060.

That gap is why employees say “the package felt smaller than the offer.” For relocation policy 2027, decide in writing –

  • Which benefits get a gross-up and which don’t.
  • Whether the lump sum is quoted gross or net in offer letters.
  • Whether the lump sum has moved since 2024. If it hasn’t, it’s worth less now.

Our relocation bonus tax guide explains the withholding side.

3. Stop Paying One National Price for Housing

Housing is where one-size-fits-all policies fail first. The mortgage lock-in is real. More than half of outstanding mortgages carry rates between 3% and 4%, and moving to a roughly 6% loan can add $730 or more a month on a comparable home (Plus Relocation).

Meanwhile, housing markets are moving in different directions. Across the country, more homes are for sale than at any time since 2019. Home prices are falling in Austin, Tampa, and Jacksonville.

However, Hartford, Chicago, and Providence still have 25% to 74% fewer homes for sale than before the pandemic. Atlas found that 28% of employees who turned down a move had housing or mortgage concerns. As a result, your relocation policy 2027 should offer housing support based on local costs.

What to change –

  • Tier your housing support by destination market. A buyer in Tampa needs different help than a buyer in Hartford.
  • Add a rent-first option with temporary or corporate housing, so nobody has to buy in a hurry.
  • Test a temporary mortgage buydown of 0.5% to 1% for the first few years.
  • Review your loss-on-sale cap. Many sit between $25,000 and $50,000, and that may not cover a drop in a softer market. Our BVO vs. GBO guide covers the buyout options.

4. Build In Flexibility, Because Your Employees Are Already Asking

Here’s a number that should bother any HR team: 52% of companies in Atlas’s 2026 survey admit they’ve lost good employees partly because of inflexible policies. And 51% say they make exceptions almost always or frequently. In other words, as you prepare your relocation policy 2027 update, remember that managers are already bending the existing rules informally.

The fix is to put the flexibility on paper. Employees say they value total financial value (58%), family support (49%) and freedom to spend relocation money how they choose (47%). Meanwhile, 78% of companies agree employees prefer lump sums.

A core-flex structure handles this well. Keep a fixed core (shipping, temporary housing) and let employees spend a flex budget on what fits their situation.

Then add the family side –

  • School concerns made the top five reasons employees decline a move in their first year on the survey.
  • Only 40% of companies offer pet support and 42% offer extended-family support, while 56% cover special-needs family members.

5. Plan for Visa Costs and Use AI to Track Spending

Visa costs and AI tools both deserve a place in your 2027 relocation plan. Therefore, employers should review these costs before setting their budgets.

Prepare for visa-related expenses. Courts have blocked the $100,000 H-1B fee announced in September 2025. Meanwhile, in August 2026, the Department of Homeland Security proposed a new fee of $103,265 for cap-subject H-1B petitions. That fee has not taken effect. Still, changes to visa rules make costs hard to predict.

According to Atlas Van Lines’ 2026 Corporate Relocation Survey, 94% of companies that move staff abroad reported a budget impact from the H-1B fee. In addition, 82% changed their relocation policies in 2025. As a result, employers should plan for extra visa costs and review each case with legal advisers. They should also consider local hiring when international transfers become too costly.

Use AI to track costs while keeping people involved. The same survey found that 63% of companies used more AI in 2025. For example, common uses included budget tracking (40%) and resume analysis (37%). However, 71% did not cut HR or relocation staff because of AI.

For 2027, employers can use AI to track budgets, spot rising costs, and reduce routine work. At the same time, HR teams should include AI tools in their relocation policy 2027 plans while handling employee questions, reviewing special cases, and supporting people throughout their moves. This way, companies can control costs while keeping employee needs in focus.

What Belongs on Your Relocation Policy 2027 Checklist?

Now turn the five fixes into a plan. A relocation policy 2027 checklist should name the task, show the risk, and set a date. Use this table to sort urgent legal work from changes you can make in the next budget cycle.

Change Why it matters Do it by
State repayment riders (CT, NY, CA) Standard clauses may be void Before Jan. 1, 2027
Written gross-up rules Taxes shrink every lump sum Next policy cycle
Housing tiers by market One national cap fits nowhere Q1 2027
Flex budget and family support 52% of people lost to rigid policies Q1 2027
Visa and AI line items Budget impact is already here Next budget cycle

Policies that bend get used. Policies that break get replaced, usually after a resignation or a lawsuit. For your relocation policy 2027 update, fix the repayment clause first, since it has a deadline, and the rest will follow.

Bring It All Together!

Your next move should not be the test case for a rule that no longer works. Start with payback terms. Then fix how you quote cash aid, set housing caps, and meet family needs. Keep visa costs in the budget, and let AI flag gaps, not make staff calls. A clear relocation policy 2027 plan helps HR set fair rules and give staff more trust in the offer. Review it before the next round of hiring, not after a move goes wrong.
